Copper Pipe Export to Canada is Subjected to AD Sunset Review

Concerns are growing in the ongoing sunset review in Canada with respect to the antidumping duties on copper pipe and tubes against five countries consisted of China, Brazil, Greece, Mexico and Korea. The Canadian government initiated the sunset review on November 21 last year, in respect of the antidumping duties petition filed by Great Lakes Copper in May 2013, on copper pipe and tubes imports from the subject five countries. The final determination of antidumping duties was made in December that year. The petitioner, Great Lakes Copper, alleged that the Korean copper pipe imports accounted for only 1.8 percent in 2010, but surged to 25.2 percent in 2012, thereby causing the material injury to the Canadian industry. The Korean copper pipe and tube imports were levied 109.8 percent antidumping duties at the high at the preliminary determination.

In the final determination, the duties were lowered to 5.5~82.4 percent ad valorem. According to the trade statistics released by Canada, the total import of copper pipe and tube increased 21 percent to $52.68 million in 2017, but downed about 50.7 percent compared with those of 2013. This implies that the import of the subject products dropped clearly.

With respect to the import from Korea, the import penetration was 27.4 percent worth $29.34 million in 2013 but decreased 94.9 percent to $1.49 million in 2017 taking the No.7 largest import source into Canadian market, the statistics mentioned. Chinese import also was significantly hit directly dropping to $1.54 million in 2017 from the No.3 largest import source for Canada in 2013 when the petition was filed. In terms of import quantities, Canada imported copper pipe and tube from Korea in the quantity of 2,351 tons in 2010; 3,001 tons in 2011; 3,930 tons in 2012; and 3,360 tons in 2013. However, the import trend sharply continued downside thereafter, i.e. 246 tons in 2014; 350 tons in 2015; 284 tons in 2016; 197 tons in 2017 and 220 tons last year, ensuing a distinct slippage compared with 2013 when the investigation started.

The sunset review in question is now being proceeded in order to extend further five years to come or terminate in consistent with the regulations. Canadian border authority will decide whether to extend another five years to impose antidumping duties depending upon the dumping practices, and the Canadian International Trade Tribunal(CITT) will finally make the determination as to whether the domestic industry has been caused material injury or threatened thereof on or about the coming April 18.

The product categories subject to the sunset review fall under 7411.10 on the Canadian HS code on the 6 digits basis, or 7411.10 on the ten digits respectively. The present applied rate is zero. The Canada’s safeguard on steel taken place as of October 25 last year excluded the copper pipe and tube products.
