On June 18, 2019, the Ministry of Industry and Trade issued Decision No.
1711 / QD-BCT to apply temporary anti-dumping (CBPG) measures to some
color coated steel products originated from China and
Korea. Accordingly, the temporary anti-dumping tax rate applied to
China's color coated steel exporters is from 3.45% to 34.27% and that of
South Korea is from 4.48% to 19.25%. Details are as following.

The Ministry of Industry and Trade began the investigation in October
2018 on the basis of the evaluation results of the dossier requesting
the application of CBPG measures of representatives of the domestic
manufacturing industry filed in August 2018.
Through nearly 8 months of preliminary investigation in accordance with
the provisions of the World Trade Organization, the Law on Foreign Trade
Management and related regulations, the Ministry of Industry and Trade
has cooperated with relevant units to review and evaluate carefully the
impact of the dumping behavior of imported goods on the performance of
the domestic manufacturing industry, the level of dumping of Chinese and
South Korean manufacturing and exporting enterprises as well as
consideration. , calculate the impact on downstream manufacturing
industries and consumers of color coated steel products.
The survey results show that, although safeguard measures in the form of
tariff quotas are being applied, the volume of imported goods in quotas
shows signs of dumping with a rather high margin, from 3.45% to 34.27%,
continues to cause significant damage to the domestic coated steel
industry.
The above dumping behavior continues to exert considerable pressure on
the performance indicators of the domestic manufacturing industry,
reflected in the criteria such as production output, sales volume,
revenue and profit, market share and inventories were volatile during
the survey period, especially in the period of the last 7 months of 2018
until now. All of these indicators showed a clear declining trend, many
of the enterprises in the country suffered losses and many production
lines had to stop working and a large number of workers had to quit
their jobs.
When deciding to apply temporary anti-dumping measures, the Ministry of
Industry and Trade referred the opinions of the parties involved in the
case and other relevant state agencies as well as based on the common
practices of other member countries of the WTO. Accordingly, for
imported goods in the quota of safeguard measures, only the temporary
anti-dumping duty will apply. For non-quota import goods, a comparison
between the temporary anti-dumping duty and the non-quota tariff and the
use of higher tariffs are compared. This application aims to eliminate
tax duplication of import businesses.
In addition, for special color coated steel products that are currently
not produced in the domestic industry such as PCM products, VCM used to
produce refrigeration and consumer electronics products and products.
PVDF products used for thermal power plants and some other special
products etc. are excluded from the scope of application of temporary
CBPG measures. As a rule, raw materials imported for export production
are not subject to anti-dumping measures.
It can be seen that the temporary anti-dumping tax ranges from 3.45% to
34.27% applied to imported goods from China and South Korea that have
been issued in accordance with the provisions of the World Trade
Organization
In the coming time, in order to make a final conclusion on the case, the
Ministry of Industry and Trade will continue to work with related
parties, verify data verification and organize a public consultation
session for all parties to opportunity to express their opinions, and
evaluate the overall impact of the case on stakeholders, including end
consumers. The case is expected to end the investigation in the fourth
quarter of 2019.
